
Bos & Glazier was approved as class action counsel for a group of
approximately 300 plaintiffs in Wyoming, Michigan, asserting claims of
nuisance and trespass. The plaintiffs' claims arose when the
groundwater in their neighborhood was contaminated with
trichloroethylene (TCE), a toxic chemical which breaks down into vinyl
chloride, a known human carcinogen. The contamination was caused when
TCE leaked out of an underground storage tank maintained by General
Motors and migrated through the groundwater beneath the neighbors'
land. This class action case involved assertions that the property
values in the neighborhood were negatively impacted by the
contamination. Bos & Glazier retained a nationally renowned expert
appraisal company to analyze the impact on properties in the area.
Bos & Glazier has had extensive experience litigating cases involving
damage to the environment, including work on the famous "Love Canal"
case involving the disposal of over 21,000 tons of toxic chemicals into
a canal near Niagra Falls, New York.
